Neely vs. West Orange-Cove Decision (2004)
Late Tuesday afternoon, State District Judge John
Dietz issued the final judgment and findings of facts and conclusions
of law in the West Orange Cove case. Several months ago
Dietz issued an oral ruling from the bench finding, among other things,
that the current funding system fails to provide public schools with
adequate funding to meet state and federal requirements. Judge Dietz
also ordered the state to pay around $4 million in attorneys’ fees
to the school districts that brought suit against the state. The
state is expected to appeal the ruling directly to the Supreme Court.
